New York’s highest court must step in to uphold the public’s right to know how taxpayer dollars are being spent – including, most pertinently, to whom the money is being given.
This is as basic as is gets: Government issues check; everyone and his brother gets to inspect its purpose and its payee. Pension payments are no exception.
Six lower court judges have missed the point while reading the statutes no more astutely than a first-year law student might.
The Empire Center, a Manhattan Institute watchdog, invoked the Freedom of Information Law to ask the state and city pension systems for retirees’ names and pension amounts.
In keeping with their lawful obligations, the state funds complied, and the Empire Center posted the data on its website, SeeThroughNY.net. The city’s police retirement system refused the center’s request, releasing only a list of pension dollar amounts without any names attached.
The system’s trustees argued that the names of retired cops should be withheld for security reasons – never mind that the names and salaries of active officers are routinely published…..
